Question: I sheikh visited our Masjid from a different city and the people told him to lead Jumu’ah Salaah. I was thinking if it was permissible for a Musaafir to lead Jumu’ah Salaah as he was a Musaafir?

Answer:

السلام عليكم ورحمة الله وبركاته

In the Name of Allaah, the Most Gracious, the Most Merciful

It will be permissible for a Musaafir to lead Jumuah Salaah. The following texts of the Fuqahaa have elaborated on this;

قال فى التنوير: وشرط لافتراضها إقامة بمصر و صحة وحرية وذكورة وبلوغ وعقل ووجود بصر وقدرته على المشى وعدم حبس وخوف  و مطر شديد

 قال فى الدر المختار: (و فاقدها) اى هذه الشروط أو بعضها (ان) اختار العزيمة و (صلاها وهو مكلف) بالغ عاقل (وقعت فرضا) عن الوقت لئلا يعود على موضعه بالنقض و فى البحر هى افضل إلا للمرأة (ويصلح للامامة فيها من صلح لغيرها فجازت لمسافر وعبد ومريض. وتنعقد) الجمعة (بهم) أى بحضورهم بالطريق الاولى

قال العلامة الشامى فى رد المحتار: (قوله من صلح لغيرها) أى لإمامة غير الجمعة فهو على تقدير مضاف والمراد الامامة للرجال فخرح الصبى لأنه مسلوب الأهلية والمرأة لأنها لا تصلح إماما للرجال

(وقوله وتنعقد بهم) أشار به إلى خلاف الشافعى رحمه الله، حيث قال بصحة إمامتهم وعدم الاعتداد بهم فى العدد الذى تنعقد بهم الجمعة وذلك لأنهم لما صلحوا للامامة فلأن يصلحوا للإقتداء أولى – عناية {رد المحتار على در المختار ص 155 ج 2}
